AFFLUX MEDIA — REAL ESTATE PHOTOGRAPHY & VIDEO SERVICE AGREEMENT

By submitting this booking request, you ("Client") agree to the following terms and conditions with Afflux Medias ("Photographer/Videographer"), effective upon confirmation of your booking. This agreement is legally binding. Do not submit if you do not agree to all terms.

1. BOOKING & CONFIRMATION

This form constitutes a booking request only and does not guarantee a reserved date. A booking is not confirmed until Afflux Medias sends written confirmation via email. A non-refundable deposit of 50% of the total estimate is required to hold your shoot date. The remaining balance is due in full on the day of the shoot, prior to commencement of any work. Afflux Medias reserves the right to refuse service at its sole discretion.

2. PAYMENT TERMS

Payment is accepted via Zelle, Venmo, PayPal, or Cash App. All payments must be made in USD. The deposit invoice will be sent via email following booking confirmation and must be paid within 48 hours to secure your date. Failure to pay the deposit within 48 hours releases the date back to general availability. Returned, disputed, or reversed payments will incur a $25 processing fee and the Client will remain responsible for the original balance owed. Afflux Medias does not accept personal checks.

3. CANCELLATION — CLIENT

Cancellations made 72 hours or more before the scheduled shoot: deposit is non-refundable but transferable to one future booking date within 90 days. Cancellations made within 48 hours of the scheduled shoot: deposit is fully forfeited with no transfer option. Cancellations made within 24 hours of the scheduled shoot or same-day no-shows: the full session fee is immediately due regardless of whether the shoot took place. Rescheduling is permitted once at no additional charge with a minimum of 72 hours notice. A second reschedule request will be treated as a cancellation and the deposit will be forfeited.

4. CANCELLATION — AFFLUX MEDIA

In the event Afflux Medias must cancel due to illness, personal emergency, equipment failure prior to the shoot, or any circumstance beyond reasonable control, the Client will receive a full refund of any deposit paid, or the option to reschedule at no additional cost — at the Client's choice. Afflux Medias is not liable for any consequential, incidental, or indirect damages resulting from such cancellation, including but not limited to lost listing opportunities, agent commissions, or property sale delays.

5. WEATHER & EXTERIOR SHOOTS

Afflux Medias actively monitors weather conditions prior to all scheduled exterior shoots. In the event of extreme or unsafe weather — defined as sustained winds exceeding 25 mph, active precipitation, lightning within the area, or an active heat advisory issued by the National Weather Service — Afflux Medias reserves the right to reschedule exterior portions of the shoot at no additional charge to the Client. Interior shoots will proceed as scheduled whenever safely possible. Afflux Medias is not liable for delays or rescheduling caused by weather conditions outside its control.

6. PROPERTY ACCESS & CLIENT RESPONSIBILITIES

Client is solely responsible for ensuring the property is shoot-ready — clean, staged, decluttered, and fully accessible — at the agreed-upon shoot time. If Afflux Medias arrives on-site and the property is not prepared or accessible, a standby delay fee of $25 per 30 minutes will be charged beginning 15 minutes after the scheduled start time. Client must provide all necessary gate codes, lockbox combinations, keys, and on-site contact information no later than 24 hours before the shoot. Afflux Medias is not responsible for any delays, shortened shoots, or missed areas caused by inaccessibility or an unprepared property.

7. COPYRIGHT & USAGE RIGHTS

Afflux Medias retains full copyright ownership of all photos, videos, and any other media created during the shoot. Upon receipt of final payment, Client is granted a non-exclusive, non-transferable license to use the delivered content solely for real estate marketing purposes related to the specific property photographed — including MLS listings, social media promotion of the listing, and print marketing. Client may not resell, sublicense, transfer, or use the content for any other commercial purpose without prior written consent from Afflux Medias. Afflux Medias reserves the right to use all delivered content for portfolio, website, and marketing purposes at any time unless Client requests otherwise in writing prior to the shoot.

8. NO GUARANTEE OF RESULTS

Afflux Medias makes no representation, warranty, or guarantee regarding the sale, lease, performance, or marketability of any listed property as a result of services rendered. Photography and video are marketing tools; outcomes are dependent on market conditions, agent effort, and factors entirely outside Afflux Medias's control. Afflux Medias shall not be held responsible for any failure to sell, reduced sale price, or missed transactions of any kind.

9. EQUIPMENT FAILURE & DATA LOSS

In the rare event of equipment malfunction, memory card failure, file corruption, or data loss that results in unusable or missing deliverables, Afflux Medias's sole and exclusive liability shall be limited to a reshoot of the affected property at no additional charge, or a full refund of amounts paid — at Afflux Medias's discretion. This is the Client's sole remedy under any theory of liability arising from technical failure.

10. INDEMNIFICATION

Client agrees to indemnify, defend, and hold harmless Afflux Medias, its owner, and any contractors from and against any and all claims, liabilities, damages, losses, or expenses arising out of or related to: (a) Client's use of the delivered content in violation of these terms; (b) inaccurate or misleading information provided by Client; (c) unauthorized access to the property; or (d) any third-party claims arising from the listing or sale of the property.

11. LIMITATION OF LIABILITY

Afflux Medias's total aggregate liability to Client for any and all claims arising from or related to services rendered under this agreement shall not exceed the total amount actually paid by Client for the specific shoot giving rise to the claim. Under no circumstances shall Afflux Medias be liable for lost profits, lost commissions, lost listings, lost sale opportunities, or any indirect, incidental, special, or consequential damages of any nature, even if advised of the possibility of such damages.

12. GOVERNING LAW

This agreement shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising from this agreement shall be resolved exclusively in the courts of Clark County, Nevada.

13. FORCE MAJEURE

Neither party shall be liable for delays or failures in performance caused by circumstances beyond their reasonable control, including but not limited to acts of God, government restrictions, pandemics, extreme weather events, or civil unrest.

14. PROPERTY AUTHORIZATION

By submitting this form, Client represents and warrants that they have full legal authority to authorize photography and videography services at the specified property — whether as the property owner, the listing agent of record, or an authorized representative of either. Client agrees to indemnify Afflux Medias against any claims arising from unauthorized access or use of the property.

15. ENTIRE AGREEMENT

This agreement constitutes the entire understanding between Afflux Medias and Client with respect to the services described. It supersedes any prior verbal or written communications. No modification to this agreement is valid unless made in writing and acknowledged by Afflux Medias.
